It is not unusual for an employer to dispute their responsibility for any injury that occurs in the workplace, especially if the circumstances are unclear or there is a lack of witnesses. On some occasions, the employee may be partially at fault and this may have an impact on the potential success of a personal injury claim.
This was the case for one of our clients, a factory worker in her 50’s, fell when walking between some equipment, where the gap was rather too narrow for safe passage. Due to the lack of space, our client lost her footing and tripped, injuring her knee very badly.
After being taken to hospital at the time, our client was unable to work for several months. She had to have a number of operations on her knee but, despite the extensive treatment, her mobility is restricted and she continues to suffer some pain in the leg. Fortunately she was able to return to work eventually, albeit to a more sedentary role.
